Those are interesting questions. Obviously it is difficult to give specific answers without knowing all the facts. If the filing claims breach of a material marital obligation it sounds like they are trying to proceed as a fault-based case. That is fairly unusual in Kansas. As to servce of process, the law requires the spouse who files the case to serve copies of the paperwork. This can be accomplished in several ways - having the sheriff or other process server deliver them, certifed mail, having the party file a pleading in the case, or, in some cases, by publishing  notice in the local newspaper. The court file should contain some proof of the notice claimed in the case.]]></description>
